House Bill No. 4408

2. Purpose:
House Bill 4408 would amend Part 821, “Snowmobile”, of 1994 PA 451 to define a peace officer for the purposes of snowmobile law enforcement. The term “peace officer” would include a deputy authorized by a sheriff to enforce this part if the deputy has satisfactorily completed at least 40 hours of law enforcement training, including training specific to snowmobile enforcement.

The authorization of part-time enforcement personnel may result in a decline in the quality or consistency of snowmobile law enforcement.
7. Arguments For the Bill:
This legislation would allow the use of part-time law enforcement personnel for snowmobile enforcement, which presumably would allow sheriffs greater flexibility in personnel deployment considering the seasonal nature of snowmobile enforcement, and may also allow more efficient use of enforcement grant funds for staffing purposes.

For the past few years, the snowmobile enforcement effort by the Law Enforcement Division of the Department has exceeded authorized appropriations by over 200 percent. The snowmobile program would benefit if appropriations were more commensurate with Statewide enforcement program needs.
